Terms and Conditions of Service


Parties to Agreement

The under-mentioned Terms and Conditions of Service constitute an Agreement between Infolad Ltd and the Customer .

Infolad Ltd, also referred to as "Infolad", is incorporated as a Private Company limited by shares in Mauritius with Registration No 54580. Its registered office is at 23, Emmaüs Street, Coromandel, Mauritius. Its official website is www.infolad.com .

Customer in this Agreement refers to any person or organization, whether registered or not, who/that is subscribed to any of the services provided by Infolad regardless of whether payment for such services has been made or not, and includes any Customer subscribing to any service through online registration where signature of Customers is not required.


Refund Policy

Infolad guarantees to refund the Customer who has paid for any service which is to be provided over a period of time, any proportionate balance of the fees in case Infolad is not in a position, for whatsoever reason, to continue to provide the service. In computing the proportionate balance to be refunded, any cost related to items which are deemed to be consumed at start of the service, such as set-up costs, name registration cost, specific softwares provided etc. and which costs are separately identified in the pricing of the service, will be deducted from the initial price.


Start of Service

The date of the start of service is the date when the service is activated by Infolad. Such start date may be notified to the Customer by email, fax, telephone or mail sent by post office. Customer is not bound to acknowledge receipt of such notices. Whether Customer utilizes the service or not, the activation date is the date of start of service.

Permissible Uses

Customers agrees to use the website or any information provided by Infolad for personal and business purposes as permissible under the laws of Mauritius. Customer shall not use the website or any page of the website, under whatsoever name, to show materials, in any form such as text, data, image, sound, video, animation, etc, which are obscene, libellous, blasphemous, abusive, misleading, aimed at personal attacks and criticism, infringing Intellectual Property Rights, or anything that are not permitted by laws in Mauritius

The Customer shall not use the website to send unsolicited bulk messages over the internet, shall not house any software or scripting that propagates computer viruses and shall not provide any forum to facilitate illegal activities including online sale of any service prohibited in Mauritius.

Customer shall not use the website for any activity, whether lawful or not that would be harmful to the reputation, goodwill or name of Infolad or its Customers.

In case Customer does not abide by the Permissible Uses, Infolad has the right, at its absolute discretion, to terminate the service without notice and no refund would be due to Customer.

Payment

Customer is responsible for payment of the appropriate fee for any service requested. Payment is normally made before activation of service and may be made:

Either

By a crossed cheque payable to Infolad Ltd and sent to its registered office at 23, Emmaüs Street, Coromandel, Mauritius.

Or

By depositing cash in the bank account of Infolad Ltd at any branch of the State Bank of Mauritius (SBM) and by sending a copy of the deposit receipt to Infolad Ltd at 23, Emmaüs Street, Coromandel.

No cash money should be sent by post.

Infolad may activate the service before payment is received if Customer has signed the offer of service letter. The service is deemed to be consumed on a daily basis at a proportionate rate during the period of subscription.
Renewal

Customer may renew by online renewal service at www.infolad.com or by sending a renewal request by post.

Plan Upgrade

The website hosting service, or any other services, can be upgraded online at any time while the subscription is valid. Any proportionate balance outstanding in the current plan is used as a credit against the new plan selected and the amount payable for the new plan is reduced accordingly.

Service Cancellation

Customer may by a written letter terminate the service under the Agreement or may cease to use the service or services at its own discretion. Such cancellation by Customer does not entitle Customer to claim any refund. In case payment was outstanding at time of cancellation, Customer remains liable to pay the full amount that was outstanding.


Web Site Hosting

Infolad is acting only as a reseller of website hosting and as such has no control over the hardwares and softwares made available by the third party, nor shall Infolad be responsible for any changes in the hardwares/softwares brought about by third party and resulting in upgrades of Customer's softwares/hardwares. The third party providing the hosting facility may from time to time lay terms and conditions of use of its own facilities. Customer is also bound to follow such terms and conditions.

Limitation of Liabilities

Infolad will be liable to Customer, should Infolad be at fault, for an amount not exceeding the proportionate balance of paid fees for service not consumed by Customer at the time such liabilities become due.

In no circumstances shall Infolad be liable to pay any damages to Customer or any other party as a result of Customer using any of the services provided by Infolad and where the Customer is being sued by a third party for matters relating to Customer's web site or web pages, or for any misuse of the service by Customer.

Customer's Responsibility

Customer shall be totally liable and responsible for any content, materials or information hosted, transmitted through or displayed in Customer's website or web pages. Customer shall indemnify Infolad or any of its Officers against any claims, damages, losses, liabilities, lawsuits, legal proceedings, legal expenses and any other related charges arising from issues related to Customer violating the conditions under this Agreement or any laws in Mauritius.

Force Majeure

While Infolad undertakes to provide a high level of service to Customer, any event or action which is deemed to be force majeure may lead to downtime in the service. Infolad shall not be liable for any downtime or unavailability of services arising from any force majeure, including war, riots, terrorist attacks, hacker's attacks, fire, flood, strikes, failures in local or global telecommunications systems, third party downtime, acts of governments or any acts of God.

Privacy Policy

Infolad shall keep all data and information concerning Customer strictly confidential and shall not disclose any information on Customer to any other party, except as provided under the laws of Mauritius in matters relating to fiscal, legal or police investigations.

Customer shall keep all information about Infolad, including Bank Account No, access passwords and username strictly confidential.

Amendments to Agreement

This agreement may be revised or amended at any time without notice. Any change will be binding and effective from the date the Agreement is posted on the official website of Infolad at www.infolad.com . Whatever be the amendments, Infolad will maintain the Refund Policy as stated above.

Validity of Agreement

The current version of this Agreement posted at www.infolad.com under the header "Terms and Conditions" is the valid Agreement between Infolad and Customer.

By subscribing to any internet based service provided by Infolad, the Customer is bound by this Agreement or any amended version thereafter.
